Whilst most couples are able to resolve financial matters amicably, there are always cases when this is sadly not possible. If all other options have been exhausted, it may be necessary for Court Proceedings to take place in order to resolve matters.

 

Contrary to many perceptions, the Court process is not glamorous, nor is it speedy. Some of the biggest disadvantages of the Court process lie with increased delay and increased costs for both parties, let alone the stress that such proceedings can bring to all concerned. Above all else, the outcome of Court proceedings is usually unpredictable.

 

Parties are encouraged to note that even during Court Proceedings, efforts to negotiate an agreed solution will remain of paramount importance. The Court takes ever-increasing steps to promote the use of dispute resolution methods to all parties in the hope that the significant costs and stress of a final hearing can be avoided. Such methods can include:

 

  • A Private Dispute Resolution meeting with an independent expert who acts as a Judge;
  • A Court based Dispute Resolution meeting with a Judge;
  • Neutral Evaluation upon disputed issues by an independent expert;
  • Arbitration
