If there has ever been a time to make a Will, then this is it.
It used to be the case that whether you made a Will or not an application for probate (called Letters of Administration when there isn’t a Will) would take about the same length of time.
That isn’t the case now because there are two different systems at work.
Online probate applications take can up to 16 weeks (this is what HMCTS probate say).
That is a long time to wait, but your loved ones will have to wait even longer if you die without a Will.
Currently, not all applications can be submitted online. For example, if you die without a Will and more than one child inherits your estate then a paper application is required. These applications take at least 20 weeks.
There are, of course, all the other good reasons to make a Will: you get to choose the people who benefit on your death, and you get to choose who will deal with your affairs. Dying without a Will means that the Intestacy Laws prevail. What happens next often comes as a shock to your loved ones. I bet most Solicitors have heard “That’s not what they would have wanted.”
