What is a TOLATA claim?

These are claims that determine the ownership of a trust of land that has been under joint ownership or sole ownership. They relate to the Trust of Land and Appointment of Trustees Act (TOLATA) 1996. The Act gives the court power to make decisions in property disputes between unmarried couples.

These can determine, following a relationship breakdown, who owns the property and who can continue to live in the property.
